General terms and conditions
Great Queensland Getaway - Promotional codes are only valid for one booking. If an invalid promotional code is used at the time of payment, your booking will be immediately cancelled unless you are able to pay the remainder of the original product price. Confirmation of valid promotional codes can take up to 24 hours.
Cancellations of confirmed bookings will be processed using the following conditions in addition to the cancellation fee of the Service Provider/Operator. More than 14 Days’ Notice: 15% of the total Booking value or $35 AUD, whichever is the lowest. Less than 14 Days’ Notice: 15% of the Total Booking value Please view the Operator’s Cancellation and Indemnity Policy prior to making payment for your booking. The $2.75 online booking fee in non-refundable. We reserve the right to offer alternative accommodation/tour of a similar standard in the case of an overbooking by the accommodation/tour operator, or for any reason beyond our control. Travel insurance is highly recommended for all bookings to provide adequate protection against unforeseen cancellation of travel.
Applicable to SeaLink Queensland ferry tours accommodation and packages. Cancellation of a booking of part thereof will incur the following fees:
More than 30 days before departure – 10% of total cost
Between 7 and 30 days before departure - 50% of total cost
Less than 7 days before departure - 80% of total cost
Within 24 hours of departure - 100% of total cost
If a scheduled ferry service in cancelled by SeaLink Queensland due to inclement weather or unforeseen circumstances a transfer to another service or full refund will be offered. A ‘no show’ will incur 100% penalty. No refunds are given on unused ferry tickets.
No refunds will be made for services not availed once travel has commenced. All refund claims must be made in writing. Please note operators (other than SeaLink Queensland) reserve the right to charge cancellation fees in addition to the above.
Hire available to drivers over 21 years. Must have full current Driver’s License – minimum one (1) year, all Australian and International licenses are accepted) Learners and Provisional licenses are not accepted. An insurance excess of $3,750.00 is payable for all and any damage occasioned during the period of use, you may choose to reduce this excess. Excess reduction of $29 per day to reduce to $1500.00 (drivers aged 21 to 24) or $1000.00 (Drivers aged 25 to 75). Drivers under 21 and over 75 excluded from cover. Visa, Mastercard and American Express accepted. Refuelling costs are at Renter’s expense Cars and rates subject to change without notice. Some roads excluded from use with vehicles. NO ACCESS TO RADICAL BAY ROAD. Radical Bay Road is significantly damaged due to flooding and lack of repair. There are extremely large and deep craters across the road for the majority of the length of the road. Driving on these roads is not only dangerous to the public, it is also harmful to the vehicles and as such our vehicles may not be driven along any part of this road. NO vehicle access to the soft sand section at the end of West Point. If you drive here and your car is bogged in the sand you will be charged an Out of bounds fee as well as the cost involved in towing the vehicle and any costs associated with having the vehicle assessed for damaged by a qualified mechanic. PLEASE NOTE: Access down Radical Bay Road towards Arthur Bay is strictly prohibited in our hire cars. There are two areas nearby that can be used for parking and our friendly staff will give you details of these. If you drive down Radical Bay Road you will be charged an Out of bounds fee, as the vehicle will need to be assessed for damages by a qualified mechanic, plus any damages found caused by travelling down this road. RAIN EVENTS: In the case of rain, all topless jeeps must have the soft tops in place. We also reserve the right to prohibit access to West Point for all hire vehicles in the event of heavy rain causing creeks to rise. DRIVING ON BEACHES: Magnetic Island has many beautiful pristine beaches. Driving vehicles on beaches is not only illegal on Magnetic Island, it is also prohibited in our hire cars and Jeeps. Penalties will be applied for breaching this policy.

All payments made on reservations are refundable if travel to Magnetic island is not permitted subject to - the travel restriction still applies 14 days before your booked arrival;

- 25% of total booking if cancelled more than 14 days prior to arrival
- 100% of the total booking if cancelled within 14 days of arrival or no show

RELEASE & INDEMNITY
Boating and cruising can be a hazardous activity particularly noting the vagaries of the wind waves and tide. You hereby waive release forgive discharge and relinquish any and all claims (including without limitation any claims for death or personal injury) that you now have or may have in the future against Pilgrim Sailing Pty Ltd its related bodies corporate directors officers masters skippers and employees shareholders agents and representatives which are connected with arise out of relate to or are incidental to any transaction or services with Pilgrim Sailing Pty Ltd.
You hereby agree to indemnify defend and hold Pilgrim Sailing Pty Ltd its related bodies corporate directors officers masters skippers employees shareholders agents and representatives harmless from and against any and all claims loss damage tax liability and/or expense that may be incurred by Pilgrim Sailing Pty Ltd its related bodies corporate directors officers employees shareholders agents and representatives arising out of or in connection with the performance of its duties as described in these Terms and Conditions including the legal costs fees and expenses of defending itself against any claim by any or all of the parties to any transaction and/or by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.
Cancellations within 48 hours of event will incur a full payment of account unless due to extreme weather exceptions as declared by the captain on the day of the charter. Cancellations greater than 48 days prior to the charter will incur a 20% admin fee which will be deducted from your deposit.
We are not fair-weather sailors and will sail even if there's a little rain. There is plenty of space below and an awning on deck. If conditions are extreme and are not conducive to a great day out: The skipper will make the decision at 3pm on the day. A full refund or reschedule (if possible) will be available if the skipper cancels the event due to extreme weather.
Some services will require a minimum number of guests to operate. In the event of minimum numbers not being reached you will receive a full refund.
PHOTOGRAPHY & MEDIA:
We may use photographs or videos of you and your guests for marketing and promotional purposes. If you do not agree to our use of any photographic or video image of you or your guests you must tell us before the commencement of your event.
